Maxwell B. Wiley: Two innocent men had been convicted of a crime they didn’t commit. When I was a student at IU McKinney School of Law, I participated in their Wrongful Convictions Clinic. Roosevelt Glenn and Daryl Pinkins were innocent men who had already served long prison sentences. They were both ultimately exonerated, but helping out on the case had a huge impact on me. I realized how high the stakes are in criminal law. Simply put, there is no room for error.
I knew from then on that I wanted to help with high-stakes cases. My career began at the Marion County Public Defender Agency, and I worked my way into the Major Felony Division. There, I took more than 90 cases to trial, handling cases ranging from petty theft to homicide.
When I moved on to the Marion County Prosecutor’s office, it was as a prosecutor. There, I handled major felony cases, which honed my skilled at trial and gave me an in-depth understanding of how both sides think. Viewing cases through the lens of a prosecutor has made me a better criminal defense lawyer because I bring that perspective to every case.
I’ve tried 26 jury trials as a prosecutor. Handled 9 murder trials and 2 trials regarding attempted murder. Coupled with my work as a criminal defender, I’ve been to trial more than 100 times and gone before a jury on more than 50 occasions.
Defending those accused of serious crimes has given me a better understanding of the human side of legal practice and motivated me to keep our clients from experiencing the unfair consequences of an unjust criminal justice system. In addition to being a good lawyer, I do my best to treat people well and use my experience to fight for my clients’ best interests on every occasion and at every turn.
It started with fighting for Roosevelt Glenn and Daryl Pinkins in law school, and it continues with fighting every day for each of our clients and their family and friends.
Thomas P. Yoder, Attorney at Law, Union Pier, Michigan
Tom Yoder focuses his practice on commercial insolvency matters, specializing in business bankruptcies and commercial workouts. Having more than 38 years of experience, he has represented every bankruptcy constituency, including secured creditors, trade creditors, Creditor's Committees, Trustees, lessees/lessors, bond holders, equity interests, selected debtors, asset purchasers, and venture capital entities. He has participated and appeared in bankruptcy cases throughout the Eastern United States, specifically the Southern Districts of New York and Delaware, and has experience in all aspects of the bankruptcy process, including estate administration, bankruptcy financing, asset sales, litigation (particularly defending preference and fraudulent conveyance adversary proceedings), discharge issues, confirmation, post-confirmation matters, and bankruptcy appeals.
Tom also practices in the areas of commercial litigation, commercial alternative dispute resolution, and state court receiverships.
Tom has been recognized for professional achievement on numerous occasions. He is a Fellow of the American College of Bankruptcy and is a former member of the board of directors of the American Bankruptcy Institute. He is a past president of the Indiana State Bar Association and has held numerous leadership positions within the Indiana State Bar Association, Indiana Continuing Legal Education Forum (President), the Indiana Bar Foundation (Fellow/Board of Directors), the Allen County Bar Association (Board of Directors), and the Seventh Circuit Bar Association. He has been awarded Sagamore of the Wabash distinction, Indiana's highest citizen honor.
An avid cyclist and runner, Tom has completed 18 marathons, including six Boston Marathons. He also has been an indoor cycling YMCA instructor for almost 20 years.
Tom is a frequent speaker at local, state, regional, and national legal education seminars, having given more than 150 presentations to lawyers and business personnel, including more than 100 for the Indiana Continuing Legal Education Forum. He has published two books on commercial bankruptcy as a co-author, winning the American Bankruptcy Institute's Publication of the Year award for 1997.
Tom has received numerous professional honors, including being an AV® Preeminent™ rated attorney by Martindale-Hubbell, based on peer review ratings. He has also been selected for inclusion for the past 25 editions of Best Lawyers in America® including being "Lawyer of the Year" in Fort Wayne several times for Bankruptcy and Creditors' Rights, Fort WayneBest Lawyers and Super Lawyers in America®.
Tom earned his B.A., cum laude, in 1974 from Hanover College and his J.D. in 1977 from Indiana University Maurer School of Law. He is admitted to practice in Indiana state courts, the U.S. Court of Appeals for the Seventh Circuit, the U.S. District Courts for the Northern and Southern Districts of Indiana, and the Bankruptcy Court for the Eastern District of Michigan.
